Law Society Complaint

Off to the New Zealand Law Society with a complaint that the committee itself had brought the NZLS into disrepute.

Hello Mary,

Thanks for the advice regarding the lawyers responsible for resolving complaints against Roger Chapman that he;

1. Charged the estate for responding to complaints



2. Refused disclosure relating to evidence that the person holding my late mothers enduring power of attorney had falsified the accounts.
   



3. Took payment by deduction from my estate to fund a bankruptcy action against me.



4. Prepared false affidavits claiming that my mothers executors held no security on my behalf. and were entitled to bankrupt me.



5. Mislead the court regarding my status as discretionary beneficiary.
   



6. Acted without title in respect of property, ie: before executors had probate of will.
   

As discussed, Mr Chapman s actions are contrary to every established trust law principal and the advice provided by the Law Society's own legal practice manual. Likewise it is contrary to the principals of natural justice to have solicitors on the committee who have acted for parties opposing me in the past and in particular Ollie Gilbert, who shared an office with Mr Chapman.

This complaint is therefore directed at the individual members of the committee named below, who have by their actions brought the society into disrepute by condoning actions of Mr Chapman, which are contrary to proper legal practice as set down by the Law Society in the Legal Practice Manual Vol 6, on estates wills and trusts. The consequences of this shameful action has led to me becoming the first person in nearly 300 years to be bankrupted at the hands of the executor of a mutual estate.

I have forwarded this complaint to the lay persons concerned, Catherine Hannan and Ruth Procter, & invite your suggestions as to an appropriate way forward.To begin, I would ask that the solicitors named be asked to provide a single equitable precedent supporting the executor of a mutual estate bankrupting a beneficiary or otherwise concede an error.
